Key points of DA's decision

October 17, 2003

Colorado law does not require that police officer James Turney retreat from the danger posed to himself and others.

Prosecutors could not prove beyond a reasonable doubt that it was unreasonable for Turney to perceive that Paul Childs was an imminent deadly threat.

If Childs had complied with repeated pleas from family and warnings from police to drop his knife, DA Bill Ritter said, the incident likely would have concluded peacefully.

Two officers armed with Taser devices were prevented by time and position from stunning Childs to avoid a shooting.

No criminal charges will be filed in Denver stemming from threats Turney allegedly made to his former mother-in-law in Iowa the day before Childs was shot.

All of the documents and taped interviews in the investigation are open to public inspection at the district attorney's office.
